Quorum:Disputed

I.Call to Order

The meeting was called to order at 09:00 EST. A quorum was declared, though the legal basis for this declaration is subject to ongoing litigation.

II.Approval of Previous Minutes

Motion to approve minutes from the previous meeting. The motion carried.

(Note: The previous meeting's decisions have since been ruled invalid by federal court.)

III.Old Business

A.Childhood Vaccine Schedule Revision

The committee previously voted to reduce recommended childhood vaccines from 17 to 11.

On March 17, 2026, U.S. District Judge Brian Murphy ruled this reduction was “probably illegal.”

The judge found that the committee, as constituted, was invalid and that earlier votes were void.

The committee noted the ruling. No corrective action was proposed.

B.Hepatitis B Recommendation for Newborns

The committee previously voted to downgrade the hepatitis B vaccine recommendation for newborns.

This vote has also been ruled invalid.

The committee noted the ruling.

C.COVID-19 Vaccine Recommendations

The committee previously voted to broadly downgrade COVID-19 vaccine recommendations.

This vote has also been ruled invalid.

The committee noted the ruling.

Summary of Old Business

All actions taken by this committee in its current constitution have been voided by federal court. The committee acknowledged these rulings. No remedial action was taken.

IV.New Business

A.Proposed Agenda Expansion: Vaccine Injuries

A proposal was submitted to add vaccine injury surveillance to the committee's jurisdiction.

This represents a shift outside what has traditionally been ACIP's jurisdiction.

Discussion deferred pending resolution of the committee's legal standing.

B.Proposed Agenda Expansion: Long COVID

A proposal was submitted to add Long COVID recommendations to the committee's scope.

Discussion deferred pending resolution of the committee's legal standing.

Status of New Business Items

All new business items have been deferred. The committee cannot expand its jurisdiction while the legality of its existence is under review.

V.Unscheduled Business: Resignation of Dr. Robert Malone

Dr. Robert Malone informed the committee of his resignation, effective immediately.

Statement from Dr. Malone (read into the record)

“Hundreds of hours of uncompensated labor, incredible hate from many quarters, hostile press, internal bickering, weaponized leaking, sabotage—I have better things to do.”

Dr. Malone further stated on social media that HHS had disbanded ACIP entirely.

Dr. Malone subsequently retracted this claim, stating it was a “miscommunication.”

Andrew Nixon | HHS Spokesperson

“Unless officially announced by us, any assertions about what we are doing next is baseless speculation.”

Dr. Joseph Hibbeln | ACIP Member

“It is good that Dr. Malone wishes now to decrease drama. This contrasts with his prior dramatic and confusing statements.”

The chair noted the resignation for the record.

VI.Acting CDC Director’s Statement

Jay Bhattacharya | Acting CDC Director

“I think it is vital that every kid in this country get the measles vaccine. Absolutely vital.”

This is the first such unequivocal endorsement of childhood vaccination from a senior Trump administration health official.

The committee noted the statement. No member seconded it.

VII.Legal Update

Counsel advised the committee of the following pending actions:

Judge Murphy's ruling that ACIP reconstitution violated the Federal Advisory Committee Act.

The ruling that committee members were not “fairly balanced” as required by law.

All previous votes (vaccine schedule, hepatitis B, COVID-19) are void.

Counsel recommended the committee refrain from additional votes pending appeal.

Motion

The committee voted to refrain from additional votes.

(This vote may also be invalid.)

VIII.Cultural Note

For the Record

Saturday Night Live aired a sketch titled “MAHAspital” on March 22, 2026, depicting a hospital operating under MAHA principles.

The sketch featured Dr. Harry Styles ordering “beef tallow and six raw eggs, stat” and Health Secretary Kennedy preparing a dead bear “for jerky.”

The committee does not endorse this portrayal. The committee does not endorse anything at this time, as its legal authority to endorse is disputed.

IX.Adjournment

Motion to adjourn. The motion carried.

The next meeting date has not been scheduled, pending resolution of the committee's legal existence.
